TERMS AND CONDITIONS – INCREDIBLE WORKPLACES CERTIFICATION PROGRAM (UAE)
The Incredible Workplaces Certification Program serves as an organization’s initial step toward developing an exceptional workplace environment and provides the opportunity to receive official Incredible Workplaces Certification.
1. AGREEMENT TO TERMS
These Terms and Conditions ("Agreement") constitute a legally binding agreement between your organization ("Organization") and IWP Media and Consulting Private Limited (UAE Branch), a legal extension of IWP Media and Consulting Private Limited, India. By submitting an application, making payment, or participating in the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. ELIGIBILITY AND AUTHORIZATION
The representative acting for the Organization warrants they possess the legal authority to bind the Organization to this Agreement. In accordance with UAE law, the Organization must be licensed to operate within the UAE (Mainland or Free Zone) and provide its Trade License details upon request.
3. ASSESSMENT PROCESS AND TIMELINES

PULSE Audit Form: Must be completed within 14 days of delivery.

Employee Survey: Requires a minimum 70% response rate within 14 days of launch.

Survey Integrity: Organizations must ensure employee participation is free from coaching, incentives, or pressure, in compliance with UAE labor dignity standards.
4. DATA PROTECTION AND PRIVACY (UAE PDPL COMPLIANCE)
In accordance with UAE Federal Decree-Law No. 45 of 2021 Regarding the Protection of Personal Data (PDPL):

Consent: Participation in the survey requires explicit, unambiguous consent from employees.

Data Subject Rights: Employees have the right to access their data, request rectification of inaccuracies, and the "Right to be Forgotten" (erasure) under specific legal conditions.

Cross-Border Transfers: As the parent company is located in India, data transferred for evaluation is protected by safeguards that ensure an adequate level of protection consistent with UAE standards.

Retention: Survey data and personal identifiers will be destroyed within 12 months of completion, unless a longer retention is required for legal or tax audits.
5. FINANCIAL TERMS AND TAXATION

Currency: All fees are quoted and payable in US Dollars ($).

6. INTELLECTUAL PROPERTY RIGHTS
All proprietary assessment methodologies, including the PULSE framework and certification logos, are protected under UAE Federal Decree-Law No. 38 of 2021 on Copyrights and Neighbouring Rights. Certified organizations receive a non-transferable right to use the recognition stamp provided it is not modified or distorted.
7. COMPLIANCE AND WITHDRAWAL FEES
Non-compliance with assessment timelines or material breach of these terms results in a withdrawal fee of USD 1,000 (plus applicable VAT). In accordance with Article 390(2) of the UAE Civil Code, this fee represents a reasonable estimate of administrative costs and resource allocation.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by UAE law, IWP’s total aggregate liability for any claim shall not exceed the total fees paid by the Organization for the Program. Liability for fraud or gross negligence cannot be excluded under Article 383 of the UAE Civil Code.
9. DISPUTE RESOLUTION AND GOVERNING LAW

Governing Law: This Agreement is governed by the Federal Laws of the United Arab Emirates and the local laws of the Emirate of Dubai.

Arbitration: Any disputes shall be finally settled by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre (DIAC). The seat of arbitration shall be the Dubai International Financial Centre (DIFC), and the language of proceedings shall be English.
10. DIGITAL ACCEPTANCE
This document is digitally binding without a physical signature under UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services. Digital acknowledgment or the initiation of payment constitutes valid legal acceptance.
